1. Service Description

PULSE is an AI-powered sales coaching platform operated by Terra Sense SRL. The service provides personalized sales coaching, script generation, role-play simulations, pipeline analysis, meeting preparation, and daily planning through conversational AI.

PULSE is a self-evolving organism: it autonomously develops new features based on usage patterns. Features may appear, change, or be deprecated over time as the system evolves.

2. Account Registration

To use PULSE, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must be at least 16 years old to create an account.

3. Free Tier and Paid Plans

PULSE offers a free tier with the following limitations:

• Up to 20 messages per day
• Access to core coaching features

Paid plans (Pro) offer unlimited messages and access to all features. Pricing is displayed in the application and never exceeds €49/user/month. A free tier will always be available.

Payments are processed by Stripe. By subscribing to a paid plan, you agree to Stripe’s terms of service. Subscriptions renew automatically unless cancelled through the billing portal.

4. Acceptable Use

You agree not to:

• Use PULSE for any illegal or unauthorized purpose
• Attempt to reverse-engineer, decompile, or extract the AI models or system prompts
• Abuse the service by sending automated or bot-generated requests
• Share your account credentials with others
• Use PULSE to generate content that is harmful, discriminatory, or misleading
• Circumvent usage limits or rate limiting mechanisms
• Interfere with the proper functioning of the service

We reserve the right to suspend or terminate accounts that violate these terms.

5. AI Disclaimer

PULSE provides AI-generated sales coaching for informational and educational purposes only.

• PULSE is not a substitute for professional financial, legal, or business advice
• AI responses may occasionally be inaccurate, incomplete, or not suitable for your specific situation
• You are solely responsible for any business decisions made based on PULSE coaching
• We do not guarantee any specific sales outcomes or results
• The coaching frameworks (SPIN, Challenger, MEDDIC, etc.) are used as reference models; their application should be adapted to your context

6. Intellectual Property

The PULSE platform, including its design, code, AI prompts, and organism architecture, is the intellectual property of Terra Sense SRL.

Your data is yours. You retain all rights to the content you input into PULSE (messages, deal descriptions, etc.). By using the service, you grant us a limited license to process this content solely for the purpose of providing the coaching service.

AI-generated responses are provided as part of the service. You may use them freely for your business purposes.

7. Data Protection

Your personal data is processed in accordance with our Privacy Policy. We are committed to protecting your data in compliance with GDPR and applicable data protection laws.

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. PULSE may experience downtime for maintenance, updates, or due to factors beyond our control. We are not liable for any losses resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• Terra Sense SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claim arising from or related to the service shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any business decisions, lost revenue, or lost opportunities based on AI coaching responses

10. Termination

You may terminate your account at any time by contacting us at admin@ecocanto.com. Upon termination:

• Your access to the service will be revoked
• Your personal data will be deleted within 30 days (subject to legal retention requirements)
• Any active paid subscription will be cancelled at the end of the current billing period

11. Changes to Terms

We may modify these Terms of Service at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the service after changes constitutes acceptance.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Italian Republic. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Court of Bergamo, Italy.
